We are committed to protecting your privacy and our full Privacy Policy is available to view at www.handypacks.eu.  Authorised employees within the company use any information collected from individual customers on a need to know basis only. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed exclusive of VAT. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

 

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

 

Ordering errors

You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

 

Forbearance

Any forbearance, indulgence or relaxation on the part of HandyPacks shown or granted to the Customer on any particular occasion in respect of any of the provisions of the Contract shall apply on that occasion only and shall not otherwise affect, diminish, restrict or prejudice the rights or powers of HandyPacks under the Contract or operate as, or be deemed to be a waiver of any breach by the Customer of the terms and conditions of the Contract.

 

Payment terms

All payments must be made at the time of order via Paypal.

 

Delivery charges

Delivery charges vary according to the type of goods ordered and the delivery time chosen and cannot be refunded.  Where delivery is to the Channel Islands, Isle of Man, Highlands and Islands, remote locations and all European and Worldwide locations we reserve the right to pass on further delivery charges, taxes and duties incurred.

 

Delivery

We will deliver the goods to the address that you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

 

Risk and ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

 

Acknowledgement and acceptance of your order

You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order and e-mail you again to confirm details. An acceptance of your order will take place on despatch of the good(s) ordered.

 

Returned Goods

All goods are non-returnable unless found to be faulty upon receipt, in which case they will normally be exchanged at no cost to the customer. All such claims must be made within seven days of receipt of the goods. No returns will be accepted without prior authorisation. Goods incorrectly ordered may be returned to us and a refund; excluding delivery charge, will be given upon receipt of the item/s being received in original condition and packaging.  We reserve the right to charge a handling and restocking fee.

 

Exclusion of liability

Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by our negligence. These disclaimers and exclusions shall be governed by and construed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

 

Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

 

Force Majeure

We shall not be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including, but not limited to, any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. If we are affected by such event we shall forthwith inform you of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

 

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
